Declaration of NSCN (Khaplang) as unlawful association

Kohima, 19th Dec: Home Department, Government of Nagaland declared NSCN (K) as Unlawful Association was published in the Department of Information and Public Relations website.

With reference to the Ministry of Home Affairs’ notification No. 3350(E) dated 28.09.2020 declaring National Socialist Council of Nagaland (Khaplang) as Unlawful Association under sub-section (1) of Section 3 of the Unlawful Activities (Prevention) Act, 1967, the Home Department, Nagaland has issued the following notification from the Ministry, the full text of which is as follows :

“Whereas, the National Socialist Council of Nagaland (Khaplang) [here in referred to as NSCN (K)], has its professed aim to create a sovereign Nagaland incorporating the Naga inhabited areas of Indo-Myanmar region by secession from the Indian Union in alliance with other armed secessionist organisations of Nagaland and North Eastern region;

And whereas, the Central Government is of the opinion that the NSCN (K), is continuously:-

i.                    aiming to create a sovereign Nagaland incorporating the Naga inhabited areas of Indo-Myanmar region by secession from the Indian Union;

ii.                  engaging in unlawful and violent activities thereby undermining the authority of the Government of India and the Governments of Nagaland, Manipur and Arunachal Pradesh and spreading terror and panicamong the people;

iii.                aligning itself with other unlawful association like the United Liberation Front of Asom (ULFA), Mettei organisations of Manipur;

iv.                indulging in kidnapping for ransom and extortion of money from businessmen, Government officials and other civilians;

v.                  embarking on a drive few recruitment of cadres to continue its terrorist activities;

vi.                establishing camps and hideouts across the international borders;

vii.              Obtaining assistance from anti-India forces in other countries to procure arms and other assistance.

viii.            Indulging in unlawful and violent activities intended to disrupt, the sovereignty and territorial integrity of India in furtherance of its objective of achieving a separate state.

And Whereas the Central Government is of the opinion that since 28.9.2015, NSCN (K) has been involved in 104 violence incidents resulting in killings of 07 security forces personnel and 06 civilians and abduction of 75 civilians.

And Whereas the Central Government is of the opinion that the aforesaid activities of the NSCN (K) are detrimental to the sovereignty and integrity of India and that it is an unlawful association;

And Whereas, the Central Government is also of the opinion that if there is no immediate curb and control of unlawful activities of the NSCN (K), the organisation may make fresh recruitment, indulge in violent, terrorist and secessionist activities, collect funds and endanger the lives of innocent citizens and security forces personnel; and therefore, circumstances do exist which render it necessary to declare the NSCN (K) as an unlawful association with immediate effect;

Now therefore, in exercise of the powers conferred by sub-section (1) of section 3 of the Unlawful Activities (Prevention) Act, 1967 (37 of 1967) (hereinafter referred to as the said Act) the Central Government hereby declares the National Socialist Council of Nagaland (Khaplang) [NSCN (K)] along with its all factions, wings and front organisations as an unlawful association.

Whereas, the Central Government having regard to the above circumstances, is of the firm opinion that it is necessary to declare the NSCN (K) along with its all factions, wings and front organisation as an unlawful association with immediate effect; and accordingly, in exercise of the powers conferred by the proviso to sub-section (3) of section 3 of the said Act, the Central Government hereby directs that this notification shall, subject to any order that may be made under section 4 of the said Act, have effect from that date of its publication in the Official Gazette.”
