Notification on birth & death certificates
The Directorate of Economics & Statistics has issued a notification stating that it has come to the notice of the Chief Registrar of Births & Deaths, Nagaland that the Births & Deaths Certificates for delayed registration are being issued by the Registrars without following the procedure as enshrined in the Registration of Births & Deaths Act 1969 and the Nagaland Registration of Births & Deaths (Amendment) Rules 1999.
As per the Registration of Births & Deaths Act 1969, the registration of birth & death is provided free of cost if registered within twenty-one (21) days of its occurrence.
Under Clause 13 (1) any birth or death of which information is given to the Registrar after the expiry of the period specified, but within thirty days of its occurrence, shall be registered on payment of such late fee as may be prescribed.
Under Clause 13 (2) any birth or death of which delayed information is given to the Registrar after thirty days but within one year of its occurrence shall be registered only with the written permission of the prescribed authority and on payment of the prescribed fee and the production of the affidavit made before a notary public or any other Office authorized in this behalf by the State Government.
Under Clause 13(3) any birth or death which has not been registered within one year of its occurrence shall be registered only on an order made by a Magistrate of first class or a Presidency Magistrate after verifying the correctness of birth and death and on payment of the prescribed fee.
Therefore, any Registrar registering and issuing Birth & Death certificates contravening the above Clauses shall be punishable as per Clauses 23 of the Act.
